Court issues ultimatum on Aveva, Nyange case

THE Kisutu Resident Magistrate’s Court yesterday gave the prosecution seven days to complete the process of preparing new charges in the 600m/- fraud and money laundering trial of Simba Sports Club President Evans Aveva and his Vice Geoffrey Nyange.

Principal Resident Magistrate Thomas Simba gave such ultimatum before adjourning the trial to August 17, after hearing complaints from the two accused persons, who have been charged jointly with two businessmen, Zacharia Hans Poppe and Franklin Lauwo, who are outside the jurisdiction of the court.

The magistrate directed the prosecutor with the Prevention and Combating of Corruption Bureau (PCCB) Leonard Swai to work on the matter within the given time, warning that there were times the court would not tolerate any more delays, as complained by the accused persons.

Hans Poppe is the Chairman of Players’ Registration Committee of Simba SC, while Lauwo is a contractor who had undertaken to construction of the club’s play grounds at Bunju in Dar es Salaam.

Earlier, Swai had informed the court that they had worked upon the orders for preparing a new charge sheet by removing into trial the two businessmen, who are outside the country to enable the hearing of the case to proceed following the completion of investigations.

However, the prosecutor was quick to point out that they have forwarded the case file to the Director of Public Prosecutions (DPP), as the hearing could not proceed without his consent. He reported to the court that the DPP has not attended to the file as he is outside the city.

“We will make follow up on the matter, following him (DPP) where he is so that he can sign the charge sheet. If he is in Dodoma, we will follow him there,” Swai told the Dar es Salaam Court.

However, the accused persons hit back by complaining that what was being done was just playing delaying tactics. It was Aveva, who first took the floor to open his mouth for the first time since his arraignment.

He reminded the court that what has been submitted by Swai was the same presented by Senior State Attorney Shadrack Kimaro, for the prosecution, in the last court appearance.
