MAHAKAMA ya Wilaya ya Maswa mkoani Simiyu imewahukumu ndugu wa damu kifungo cha miaka isiyopungua 20 jela baada ya kupatikana na hatia ya kuishi kama mke na mume.
Ndugu hao watoto wa baba na mama mmoja, Mussa Shija (33) na Pili Shija (36) wanadaiwa kutenda kosa hilo kinyume na na kifungu cha 158 (1) (b) na Kifungu cha 160 cha Sheria ya kanuni ya adhabu Sura ya 16, Marejeo ya Mwaka 2022.
Vijana hao walikuwa wakiishi katika Kijiji cha Madang’ombe wilayani Maswa na walikuwa wamezaa mtoto mmoja.
Hakimu mkazi, Azizi Khamis alimhukumu Mussa Shija kifungo cha miaka 30 jela na Pili amehukumiwa kifungo cha miaka 20 jela.
Katika kesi hiyo namba 10745/2025 Mwendesha Mashitaka wa Serikali, Vedastus Wajanga alidai washitakiwa hao walikuwa wanakabiliwa na kosa la kuzini na maharimu kwa maana ya kujamiana na ndugu yako wa damu.
Wajanga alidai katika tarehe na miezi tofauti mwaka 2018 hadi Julai 30, mwaka jana waliishi kama mke na mume katika Kijiji cha Mandang’ombe wilayani Maswa, Mkoa wa Simiyu.
Alidai Julai 31, mwaka jana washitakiwa walikamatwa na kufikishwa Kituo cha Polisi Maswa na Agosti 12, mwaka jana walifikishwa mahakamani.
Wajanga alidai washitakiwa walikiri mahakamani kuwa walitenda kosa hilo na walihukumiwa mwaka jana.
Hata hivyo, alisema washitakiwa walikata rufaa Mahakama Kuu nayo ikaamru shauri lisikilizwe upya katika mahakama ya awali iliyowahukumu.
Mahakama ya Wilaya ya Maswa ilianza kusikiliza upya shauri hilo, washitakiwa walisomewa shitaka na walikana kutenda kosa hilo.
